Terms of Service

1. Acceptance of Terms

By accessing or using Pigeon, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service. Pigeon reserves the right to update these terms at any time, and continued use of the service constitutes acceptance of changes.

2. Eligibility

You must be at least 16 years of age to create a Pigeon account. By creating an account, you represent that you meet this requirement and are fully able to agree to these terms.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorised use. Pigeon is not liable for losses due to unauthorised access to your account.

4. Acceptable Use

You agree not to: use Pigeon for unlawful purposes; harass, abuse, or harm others; distribute spam, malware, or malicious content; attempt to gain unauthorised access to any part of the service; impersonate other users or Pigeon staff; or violate any applicable laws or regulations.

5. Content

You retain ownership of content you share through Pigeon. By using the service, you grant Pigeon a limited licence to store, process, and transmit your content to provide the service. We may remove content that violates these terms or applicable law.

6. Premium Services

Certain features require a paid subscription managed through our payment provider. Pricing, billing cycles, and cancellation terms are presented at purchase. Subscriptions auto-renew unless cancelled before the renewal date.

7. Termination

We may suspend or terminate your account for violating these terms, engaging in harmful behaviour, or at our discretion with reasonable notice. You may delete your account at any time through your profile settings.

8. Data Collection & Processing (GDPR)

PigeonChat acts as the Data Controller for all personal data processed through the service. We process data under the following legal bases as defined in GDPR Article 6(1):

  • Consent (Art. 6(1)(a)): You explicitly agree to our terms, data collection, and GDPR compliance during signup.
  • Contractual Necessity (Art. 6(1)(b)): Processing required to provide messaging services.
  • Legitimate Interest (Art. 6(1)(f)): Security, fraud prevention, and service improvement.
  • Legal Obligation (Art. 6(1)(c)): Compliance with applicable laws and regulations.

Data we collect includes: name, email, profile information, messages, media files, usage data (login times, device info, IP addresses), demographic data (gender, date of birth), and consent records (timestamp, IP address, user agent of when you accepted our terms).

9. Your GDPR Rights

Under the General Data Protection Regulation (GDPR), you have the following rights:

  • Right of Access (Art. 15): Request a copy of all personal data we hold about you.
  • Right to Rectification (Art. 16): Request correction of inaccurate or incomplete data.
  • Right to Erasure (Art. 17): Request deletion of your personal data ("right to be forgotten"), subject to legal retention obligations.
  • Right to Restrict Processing (Art. 18): Request limitation of processing in certain circumstances.
  • Right to Data Portability (Art. 20): Receive your data in a structured, machine-readable format.
  • Right to Object (Art. 21): Object to processing based on legitimate interests or direct marketing.
  • Right to Withdraw Consent: Withdraw previously given consent at any time without affecting prior processing.

10. Law Enforcement & Regulatory Cooperation

PigeonChat cooperates with law enforcement agencies and regulatory authorities as required by applicable law. We may disclose user data, including consent logs, messages, and account information, when:

  • Required by a valid court order, warrant, or legal process.
  • Necessary to prevent imminent harm or protect user safety.
  • Required to comply with regulatory investigations (e.g., data protection authorities under GDPR Art. 58).

Consent records are maintained for a minimum of 5 years after account creation or last activity to demonstrate GDPR compliance (Art. 7(1)) and to cooperate with regulatory inquiries.

11. Limitation of Liability

Pigeon is provided "as is" without warranties. To the maximum extent permitted by law, Pigeon shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

12. Changes to Terms

We may update these terms periodically. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance. The consent version at the time of your agreement is recorded in our consent logs.

13. AI Features & EU AI Act Compliance

PigeonChat offers optional artificial-intelligence features under the name Pigeon AI (an AI chat assistant and AI image generation). These features are operated in accordance with the EU Artificial Intelligence Act (Regulation (EU) 2024/1689). By using Pigeon AI you acknowledge and agree to the following:

  • Transparency (Art. 50(1)): You are clearly informed, in the interface, that you are interacting with an AI system. All responses and images are generated by AI and may be inaccurate, incomplete, or unintended — always verify important information independently.
  • AI-generated content marking (Art. 50(2)): Every image produced by Pigeon AI is marked as artificially generated. A visible label — the PigeonChat mascot together with the wording “AI generated by pigeonchat.site” — is embedded at the bottom of each generated image. You agree not to remove, obscure, or alter this marking.
  • Risk classification: Pigeon AI is a limited-risk AI system used for general assistance and content creation. It is not used for biometric identification, social scoring, or any practice prohibited under Article 5 of the Regulation.
  • Human oversight: AI output is provided as assistance only. You remain responsible for how you use it, and Pigeon AI does not make automated decisions producing legal or similarly significant effects about you.
  • Acceptable use: You must not use Pigeon AI to generate unlawful, deceptive, infringing, or harmful content, to create deepfakes misrepresenting real persons, or to attempt to bypass its safety and content-safety controls.
  • Record-keeping (Art. 12): To demonstrate compliance and to keep the service safe, we log AI interaction events (such as when AI content is generated and when an image is marked as AI-generated). These records are retained and may be exported by administrators and shared with competent authorities on valid request.

Information We Collect

We collect information you provide directly: name, email, profile photo, messages, media files, and account settings. We also collect usage data such as login times, device information, IP addresses, and interaction patterns to maintain and improve the service.

We optionally collect demographic information such as gender and date of birth. This data is used solely to produce aggregated, anonymous audience insights (e.g. age-group and gender distribution charts) for internal analytics and service improvement. Demographic data is never shared individually with third parties.

How We Use Your Information

Your data is used to: provide messaging and communication features; verify your identity and secure your account; improve and personalise the service; send important service notifications; detect and prevent abuse, fraud, and security incidents.

Data Storage & Security

Your messages, media, and account data are stored on secure cloud servers with industry-standard encryption. We implement TLS encryption for data in transit and encryption at rest. Access to user data is restricted to authorised personnel on a need-to-know basis.

Cookies & Analytics

Pigeon uses cookies for authentication and preferences. We use Google Analytics to understand how users interact with the service, including page visits, feature usage, and session duration. This data is aggregated and does not personally identify you.

Third-Party Sharing

We do not sell your personal data. We may share anonymised, aggregated data with analytics providers. We may disclose information when required by law, to protect user safety, or to enforce our terms.

Data Retention & Deletion

Your data is retained as long as your account is active. When you delete your account, we remove your personal data within 30 days, except where retention is required by law. You may request data export or deletion by contacting support.

Your Rights

Depending on your jurisdiction, you may have rights to: access your data; correct inaccurate data; request deletion; object to processing; data portability. Contact us to exercise these rights.

🛡️ GDPR Compliance

How we protect your data under EU regulation

PigeonChat is fully committed to compliance with the General Data Protection Regulation (EU) 2016/679. During signup, users explicitly consent to:

  • Terms of Use: Acceptance of our full terms of service governing platform usage.
  • Data Collection: Consent to collection of personal data including name, email, profile info, messages, media, usage data, and demographic information.
  • GDPR Compliance: Acknowledgement of data processing under GDPR legal bases and awareness of all data subject rights.

📋 Consent Record Keeping

Every consent action is recorded with a timestamp, IP address, and browser information to demonstrate compliance with GDPR Art. 7(1). These records are retained for a minimum of 5 years and can be provided to data protection authorities upon request.

🏛️ Regulatory Cooperation

PigeonChat cooperates fully with data protection authorities and law enforcement agencies. Consent logs and user data may be disclosed pursuant to valid legal process, court orders, or regulatory investigations under GDPR Art. 58.

🤖 EU AI Act Compliance

Our AI features under Regulation (EU) 2024/1689

PigeonChat's AI features (Pigeon AI — AI chat and AI image generation) are designed and operated to comply with the EU Artificial Intelligence Act (Regulation (EU) 2024/1689). Pigeon AI is a limited-risk AI system, and our obligations centre on transparency, safe use, and record-keeping.

  • Clear AI disclosure (Art. 50(1)): A persistent notice in the chat makes it unmistakable that you are interacting with an AI system and that its output is AI-generated.
  • Marked AI images (Art. 50(2)): Every AI-generated image carries a visible mark — the PigeonChat mascot and the wording “AI generated by pigeonchat.site” — embedded at the bottom of the image.
  • No prohibited practices (Art. 5): Pigeon AI is never used for social scoring, manipulative techniques, or biometric identification.
  • Human oversight & safety: AI output is assistance only; content-safety filters and abuse controls guard against misuse, and you stay in control of how output is used.

📋 AI Record-Keeping (Art. 12)

Material AI events — interactions, content generation, AI-image marking, and blocked requests — are logged with a timestamp and, where relevant, the module and model used. Administrators can review and export these logs (CSV) to demonstrate compliance and cooperate with competent authorities.
